uSpeak respects your right to privacy and is committed to safeguarding the privacy of students, guardians, school staff, and other users of our platform. This policy sets out how we collect and treat personal information.
We adhere to the Australian Privacy Principles contained in the Privacy Act 1988 (Cth) and relevant state-based child safety and education legislation across Australia, including but not limited to laws governing the protection of minors and mandatory reporting obligations.
"Personal information" is information we hold which is identifiable as being about you. This includes information such as your name, email address, role (student, guardian, or staff), school affiliation, and the content of any incident reports submitted through uSpeak.

2. What personal information is collected
uSpeak will, from time to time, receive and store personal information you submit to our platform, provided to us directly or via your school.
We may collect:
- Account details such as your name, email address, and role (student, guardian, or staff)
- School affiliation, year level, and house or class group
- Incident reports you submit, including descriptions, evidence, and the names of any individuals you choose to identify in those reports
- Relationships between students and guardians, where established through guardian-minor linking
- Communications with our support team
- Internet or electronic network activity such as browsing history within uSpeak, interactions with the platform, and IP address
We do not sell personal information. We do not use personal information for advertising.
3. How we collect your personal information
uSpeak collects personal information directly from you when you create an account, submit a report, or interact with the platform. We also collect information from schools who provide student rosters and from guardians who link to their child's account.
By providing personal information, you consent to its use as described in this Privacy Policy.
4. How we use your personal information
We use personal information to:
- Provide the uSpeak platform and its features to you and your school
- Process and route incident reports to the appropriate school staff
- Link guardians to their children where authorised
- Communicate with you about reports, updates, and service announcements
- Investigate complaints or misuse of the platform
- Comply with legal and mandatory reporting obligations
If you withhold personal information, it may not be possible for us to provide uSpeak services to you.
We do not discriminate against you for exercising any of your privacy rights.
We may disclose your personal information to comply with a legal requirement, such as a law, regulation, court order, subpoena, or law enforcement request, or where required by mandatory reporting obligations.
5. Handling of information involving minors
uSpeak processes incident reports that frequently involve minors. We take this responsibility seriously.
- Information about minors is treated with heightened care and is accessible only to appropriate parties (the minor, their authorised guardian, and designated school staff)
- We do not knowingly market to minors
- Schools and guardians retain primary responsibility for ensuring appropriate use of the platform by students under their care
- Where a minor submits a report, our handling complies with the Privacy Act 1988 (Cth) and applicable state child protection legislation
6. AI and automated processing
uSpeak uses automated tools to assist with categorising incident reports by severity and event type. These tools do not make binding decisions and are subject to school staff review.
By using uSpeak, you acknowledge that automated outputs may not always be accurate or free from bias. Final decisions about how to respond to incidents remain with school staff. We do not use AI to profile users or to make decisions producing legal or significant effects on users.
7. Organisational accounts
Schools access uSpeak under an organisational arrangement. The school is responsible for managing its users' access and ensuring its users comply with these Terms.
Individual users within a school retain personal access to their own account information. The school's designated administrators have access to incident reports and account-level information for the purposes of their child safety and wellbeing functions.
Upon termination of an organisational arrangement, user accounts provisioned under that arrangement may be deactivated, in accordance with the relevant agreement.
Data deletion requests from schools should be directed to support@uspeak.au.
8. Disclosure of your personal information
We may disclose your personal information to:
- Designated school staff at your school, for the purposes of receiving and acting on incident reports
- Linked guardians, where permitted under our guardian-minor linking rules
- Our employees, professional advisers, agents, and subcontractors, insofar as reasonably necessary for the operation of uSpeak
- Law enforcement or regulatory bodies, where required by law or mandatory reporting obligations
If we disclose your personal information to a third party, we will protect it in accordance with this Privacy Policy.
9. Hosting and data storage
uSpeak data is stored within Australia using cloud infrastructure providers that meet Australian data protection standards. We take reasonable steps to ensure that any storage or processing is consistent with the Australian Privacy Act 1988 (Cth).
We may share personal data with third-party service providers, cloud storage providers, and analytics tools that help us operate uSpeak. These providers are bound to appropriate confidentiality and security standards.
10. Security of your personal information
uSpeak is committed to protecting your personal information from unauthorised access, loss, misuse, disclosure, alteration, or destruction. We use industry-standard security measures, including:
- Encryption of data in transit (TLS) and at rest
- Role-based access controls
- Authentication mechanisms
- Routine security assessments
You are responsible for keeping your login credentials secure. uSpeak is not responsible for data loss or unauthorised access resulting from weak passwords or credential sharing.
If we become aware of a data breach that compromises your personal information, we will promptly notify affected individuals and relevant authorities within the timeframes required by law.
No method of transmission over the internet is 100% secure, so we cannot guarantee absolute security.
11. Access to your personal information
You may request details of personal information that we hold about you, under the Privacy Act 1988 (Cth). If you would like a copy of the information we hold about you, believe it is inaccurate, or wish to request its deletion, please contact us at support@uspeak.au.
We may require additional information to verify your identity before fulfilling your request.
We retain personal information only for as long as necessary to fulfil the purposes for which it was collected, or as required by applicable laws. Personal data is securely deleted or anonymised once the retention period expires.
12. Account inactivity
uSpeak may deactivate accounts that remain inactive for a continuous period of 12 months. Before deactivation, we will send a notification to your registered email at least 30 days in advance.
If required by law, certain data may be retained for compliance, security, or dispute resolution purposes.
13. Complaints about privacy
If you have any complaints about our privacy practices, please contact us at support@uspeak.au. We take complaints seriously and will respond after receiving written notice.
If you are not satisfied with our response, you may contact the Office of the Australian Information Commissioner (www.oaic.gov.au).
14. Changes to this Privacy Policy
We may modify this Privacy Policy at any time. All modifications will be effective immediately upon posting. Material changes will be communicated to registered users via email or in-app notification at least 14 days prior to taking effect.
Your continued use of uSpeak following notification of any changes constitutes acceptance of the updated Privacy Policy.
15. Website and cookies
When you visit our website, we may collect certain information such as browser type, operating system, and pages visited. This information is used in an aggregated manner to analyse how people use our site so we can improve our service.
We may use cookies to identify you when you return to the site and to store details about your use. Most web browsers automatically accept cookies, but you can choose to reject them by changing your browser settings.
