1. About uSpeak
uSpeak is an anti-bullying and school incident management platform that allows students, guardians, and school staff to report and respond to bullying and wellbeing incidents.
uSpeak is operated by uSpeak (ACN 000 000 000). Access to and use of uSpeak, or any of its associated products or services, is provided by uSpeak. By using uSpeak, you agree to be bound by these Terms.
We may review and update these Terms at any time by posting changes to this page. Changes take effect from the date of their publication.
2. Acceptance of the Terms
You accept these Terms by using uSpeak. You may also accept them by clicking to accept or agree where this option is presented to you.
3. Eligibility and age requirement
uSpeak is intended for use by students, guardians, and school staff within an organisational arrangement with a school. Where users are under 13 years of age, their use must be authorised by a parent, guardian, or another responsible adult (such as a teacher) who agrees to be bound by these Terms.
By allowing a child to use uSpeak, the responsible adult agrees to supervise the child's use and assumes responsibility for their activities on the platform.
If uSpeak becomes aware that a child has created an account without appropriate authorisation, the account may be suspended or terminated.
4. Account types
uSpeak provides accounts to three user types:
- Students: minors at participating schools
- Guardians: parents or carers of students at participating schools
- Staff: academic staff, administrators, and wellbeing leaders at participating schools
The features available to each account type are described on the uSpeak website and may change at our discretion.
5. Organisational access
Schools access uSpeak under an organisational pilot, enterprise, or licensing arrangement. The scope, duration, and features available are determined by the relevant agreement between uSpeak and the school.
In the event of conflict between these Terms and the terms of a school's organisational agreement, the agreement shall prevail to the extent of the inconsistency.
6. Your responsibilities
When using uSpeak, you agree to:
- Provide accurate information when creating an account
- Use uSpeak in good faith and only for its intended purpose (reporting and managing wellbeing incidents)
- Not submit knowingly false, malicious, or vexatious reports
- Not use uSpeak to harass, threaten, or harm others
- Keep your login credentials secure
- Comply with your school's policies regarding student conduct online
Misuse of the platform may result in account suspension or termination.
7. Confidentiality and reporting
Reports submitted through uSpeak may be confidential or anonymous, depending on the submitter's choice and the platform's settings.
uSpeak passes reports to designated staff at the relevant school. We do not provide direct interventions and are not a substitute for emergency services or professional support.

8. Mandatory reporting
School staff using uSpeak remain subject to their mandatory reporting obligations under state and territory child safety legislation. uSpeak does not replace or override those obligations.
In some circumstances, uSpeak may be required to disclose information to law enforcement, child safety authorities, or other regulatory bodies as required by law.
9. Content ownership and use
You retain ownership of any content you submit to uSpeak, including incident reports and any evidence you upload. By submitting content, you grant uSpeak a limited licence to store, process, and share that content as needed to provide the uSpeak service, including sharing with appropriate school staff and guardians.
uSpeak does not claim ownership of user-submitted content.
10. AI-generated content
uSpeak uses automated tools to categorise incident reports by severity and event type. These outputs are estimates only and are subject to review by school staff. Automated outputs may not always be accurate or free from bias. Final decisions about incident response are made by school staff.
11. Service availability
uSpeak is provided on an "as is" basis. We do not guarantee uninterrupted or error-free service. We may modify, suspend, or discontinue any part of uSpeak at any time, with or without notice.
We are not liable for any loss arising from service interruptions, data loss, or third-party actions, except to the extent required by non-excludable laws.
12. Limitation of liability
To the maximum extent permitted by law, uSpeak excludes all liability for indirect, incidental, or consequential losses arising from your use of the platform.
Nothing in these Terms excludes any guarantees, warranties, or rights that cannot be excluded under the Australian Consumer Law or other non-excludable laws.
13. Termination
You may terminate your uSpeak account at any time by contacting support@uspeak.au.
We may suspend or terminate your account if you breach these Terms or your school's organisational agreement, or if your continued use of uSpeak poses a risk to other users.
14. Changes to these Terms
We may update these Terms from time to time. Material changes will be communicated to registered users via email or in-app notification at least 14 days prior to taking effect.
Your continued use of uSpeak following notification of any changes constitutes acceptance of the updated Terms.
15. Governing law
These Terms are governed by the laws of Victoria, Australia. You agree to submit to the jurisdiction of the courts of Victoria, Australia, in relation to any dispute arising from or in connection with these Terms or your use of uSpeak.
